Obtain information about your data stored by us and its processing, correct incorrect personal data, delete your data stored by us, restrict data processing if we are not yet allowed to delete your data due to legal obligations, object to the processing of your data by us and data portability if you have consented to the data processing or concluded a contract with us.

Purposes of data processing by the controller and third parties
We will only process your personal data for the purposes set out in this Privacy Policy. We do not transfer your personal data to third parties for purposes other than those stated. We will only disclose your personal data to third parties if:

  • the processing is necessary for the performance of a contract with you,
  • the processing is necessary for compliance with a legal obligation or
  • the processing is necessary for the protection of legitimate interests and there is no reason to assume that you have an overriding interest worthy of protection in the non-disclosure of your data.

Deletion or blocking of data
We adhere to the principles of data avoidance and data economy. We therefore only store your personal data for as long as is necessary to achieve the purposes stated here or as stipulated by the various storage periods provided for by law. After the respective purpose has ceased to exist or these periods have expired, the corresponding data is routinely blocked or deleted in accordance with the statutory provisions.

Web hosting
The website www.annajuan.ch is hosted by Hostpoint AG, Neue Jonastrasse 60, 8640 Rapperswil-Jona, Switzerland (hereinafter “Hostpoint”).

In order to be able to provide the hosting service in a technically flawless manner and in compliance with the law, so-called log files are created by the Hostpoint servers. These always include the following data of visitors to this website:

  • IP address
  • Browser
  • Date and time
  • URL called up
  • Referrer
  • Protocol used
  • Possible error messages

This data remains on the Hostpoint systems until the expiry of the statutory period and is then automatically deleted. There is a so-called data processing agreement (DPA) between Hostpoint AG and Anna & Juan KLG to protect your rights.

Collection of general information when you visit our website
When you access our website, information of a general nature is automatically collected by means of a cookie (see also section “Cookies”). With the help of the Meta pixel, it is possible for Facebook, Instagram and other Meta services to determine the visitors to our online offer as a target group for the display of advertisements (so-called “Meta ads”). Also based on our legitimate interests, we use the “Custom Audiences from File” procedure of the social network Meta Platforms, Inc. In this case, the email addresses of the newsletter recipients are uploaded to Meta. The upload process is encrypted. The upload is used solely to determine recipients of our Meta ads. In this way, we want to ensure that the ads are only displayed to users who are interested in our information and services.

The processing of the data by Meta takes place within the framework of Meta’s data usage policy. Google Maps is only used after the use of cookies has been granted in the “Necessary” category when visiting this website. To subsequently revoke the use, the cookies must be deleted in the browser settings.

Use of Google ReCaptcha
We use “Google reCAPTCHA” (hereinafter “reCAPTCHA”) on our websites. The provider is Google Inc, 1600 Amphitheatre Parkway, Mountain View, CA 94043, USA (hereinafter “Google”).

The purpose of reCAPTCHA is to check whether data entry on our websites (e.g. in a contact form) is made by a human or by an automated programme. For this purpose, reCAPTCHA analyses the behaviour of the website visitor on the basis of various characteristics. This analysis begins automatically as soon as the website visitor enters the website. For the analysis, reCAPTCHA evaluates various information (e.g. IP address, time spent by the website visitor on the website or mouse movements made by the user). The data collected during the analysis is forwarded to Google and stored on a Google server.

The reCAPTCHA analyses run entirely in the background. Website visitors are not informed that an analysis is taking place. The data processing is based on article 6 para. 1 lit. f GDPR. The website operator has a legitimate interest in protecting its web offers from abusive automated spying and from SPAM.

Other plugins and services in use

WPML
The WPML plugin uses cookies to identify the current language of the visiting person, the last language visited and the language of the logged-in user. This data is stored when an order is placed. No data is transferred to the provider of the plugin, OnTheGoSystems Limited, 22/F 3 Lockhart Road, Wanchai Hong Kong.

Events Manager and Events Manager Pro
We store the information you enter during the booking process to reserve your places at our event. We transmit this ssL encrypted via email to you and us. The data collected are: First name, last name, address, email address, phone number, ticket type, event and venue information, method of payment (bank transfer, Paypal or Stripe [credit card payment]) and the optional information about your language preference and how you found out about our offers.

If you pay via the payment providers PayPal or Stripe, your data will be transferred to them in accordance with the description under the points “PayPal” and “Stripe” below.

We generally store your data for as long as we need it for the purposes for which we collect and use it and as long as we are legally obliged to do so. For example, we store billing information for tax and accounting purposes for 10 years. This includes your name, email address and booking details.

We use cookies to temporarily store information during the booking process and error and success messages.

We use Google services to provide maps. We collect the resulting data in accordance with Google’s privacy policy. Please see “Use of Google Maps” in the left column.

WooCommerce – Anna & Juan Online Store
We collect information about you during the checkout process in our shop as follows.

While you are visiting our site we track and store:

  • Products you have viewed: We use this information to show you, for example, products you have recently viewed.
  • Location, IP address and browser type: We use this information to calculate, for example, taxes and shipping costs.
  • Delivery address: We ask you to enter this so that we can, for example, estimate shipping costs before you place an order and send it to you.

We also use cookies to store the contents of your shopping basket while you are browsing our website.

When you shop with us, we ask you for information such as your name, billing address, shipping address, email address, phone number, credit card/payment information, and optional account information such as your username and password. We use this information for the following purposes, among others:

  • To send you information about your account and your order
  • To respond to your enquiries, including refunds and complaints
  • To process payments and prevent fraud
  • If requested to set up your account for our shop
  • To comply with our legal obligations, such as the calculation of taxes
  • To improve our shop offer

When you create an account, we store your name, address, email address and phone number, which we use for future orders.

We generally store your information for as long as we need it for the purposes for which we collect and use it and as we are required to do by law. For example, we store order data for tax and accounting purposes for 10 years. This includes your name, email address, billing and delivery address.

To facilitate contract processing, refunds or cancellations, we will automatically delete the following data after the specified period:

  • Unused user account: 1 year
  • Unconfirmed order: 60 days
  • Missed order: 7 days
  • Cancelled order: 7 days
  • Settled order: 10 years (legal retention requirement Switzerland)
  • Stripe ID*: 1 year

* Stripe will give you an ID if you choose to store your credit card details at Stripe yourself for future purchases.

Members of our team have access to the information you provide. For example, both administrators and shop managers can access it:

Order information, such as what was purchased, when it was purchased, and where it should be sent; and Customer information, such as your name, email address, and billing and shipping information.

Our team members have access to this information to fill orders, process refunds and assist you.

Transfer of data to third parties for services.
If services are requested, personal data provided may be passed on to third parties for the purpose of carrying out these services. For example, in the case of shop orders, all necessary details may be passed on to the transport company and its partners for the purpose of smooth delivery, or in the case of course bookings, names and contact details (telephone number and e-mail address) may be passed on to external course instructors, provided that this serves the smooth implementation of the offer. The forwarding of data is exclusively for specific purposes.

Swiss Post and other transport services
Swiss Post or selected carriers will receive your following information in order to process and deliver your order:

If you select payment via PayPal, you will be redirected to PayPal and the data provided or collected by you during the order process (such as name, e-mail address, payment information, address, IP address, browser, operating system and device type) will be transmitted to PayPal. The payment is processed directly on the PayPal site, PayPal login and credit card details are never stored on our sites. The privacy policy of PayPal applies.

The transfer of your data to PayPal is based on article 6 para. 1 lit. a GDPR (consent) and article. 6 para. 1 lit. b GDPR (processing for the performance of a contract). Stripe
On our website, we offer, among other things, payment via Stripe. The provider of this payment service is Stripe, 185 Berry Street, Suite 550, San Francisco, CA 94107, USA (hereinafter “Stripe”).

If you choose to pay via Stripe, the data you provide or collect when placing an order (such as name, email address, payment information, address if applicable, IP address, browser, operating system and device type) will be transmitted to Stripe. The Privacy Policy of Stripe applies.

TWINT
On our website we offer, among other things, payment via TWINT. The provider of this payment service is TWINT AG, Stauffacherstrasse 41, 8004 Zurich, Switzerland (hereinafter “TWINT”).

If you select payment via TWINT, the total amount of your order, your name and the order number are transmitted to TWINT. TWINT also assigns a transaction number. The Data protection declaration of TWINT applies.

Bexio and Raptus WooCommerce Bexio Automator
The data required for accounting and tax reasons (contact details [first name, last name, address, e-mail address, telephone number, language choice]) as well as all order details (products, quantity and price details), shipping and payment methods are automatically transferred to the accounting system bexio.com via the plugin “Raptus WooCommerce Bexio Automator”.

There is a so-called data processing agreement (DPA) between bexio AG and Anna & Juan KLG to protect your rights and the privacy policy of bexio AG is applied: https://www.bexio.com/de-CH/richtlinien/datenschutz.

The transfer of your data to bexio AG is based on article 6 para. 1 lit. a GDPR (consent) and article. 6 para. 1 lit. b GDPR (processing for the performance of a contract). Your data will be stored on the website server, transmitted to us and to you in encrypted form (via ssL) by e-mail and stored for tax purposes. The offices we use for the annual accounts, Kabo-Treuhand AG, Aemtlerstrasse 36, 8003 Zürich and Leisa Fügli Treuhand Aarau, Kasinostrasse 25, 5000 Aarau, Switzerland, have full access to the data (printed and/or digital). Furthermore, the data may be viewed by the competent authorities and courts for tax and legal purposes.

WooCommerce Multilingual
WooCommerce Multilingual uses cookies to understand shopping cart info when using languages in domains and to transfer data between domains.

WooCommerce Multilingual also uses cookies to identify the language and currency of each customer’s order, as well as the language of reports generated by WooCommerce. WooCommerce Multilingual enhances these reports by adding currency information.

Wordfence
We have embedded Wordfence on this website. The provider is Defiant Inc, Defiant, Inc, 800 5th Ave Ste 4100, Seattle, WA 98104, USA (hereinafter Wordfence).

Wordfence serves to protect our website from unwanted access or malicious cyberattacks. For this purpose, our website establishes a permanent connection to Wordfence’s servers so that Wordfence can check its databases against the accesses made to our website and block them if necessary.

The use of Wordfence is based on article 6 para. 1 lit. f GDPR. The website operator has a legitimate interest in protecting its website as effectively as possible against cyberattacks. If a corresponding consent has been requested, the processing is carried out exclusively on the basis of article. 6 para. 1 lit. a GDPR; the consent can be revoked at any time.

Conclusion of a contract on commissioned processing:
We have concluded an order processing contract with Wordfence. This is a contract required by data protection law, which ensures that Wordfence only processes the personal data of our website visitors in accordance with our instructions and in compliance with the GDPR.

Forminator Forms
When you submit a form, we collect the IP address to protect against spam. We also collect the email address and any personal information you have entered into the form fields. Your information is automatically deleted after one year, your IP address after five days. You can also request the complete deletion of your details at an earlier point in time.

Booking requests to Gästehaus Hunziker, 8050 Zurich, are automatically transmitted to them (without the IP address).

Redirection
The Redirection plugin records calls to non-existent URLs (404 errors) within this website. It stores the operating system, the browser and an anonymised form of the IP (the last three digits are missing). This allows us to draw conclusions as to whether the call was made by a visiting person, a team member of Anna & Juan KLG or a bot. This allows us to deduce whether there is a bug that needs to be fixed or the bug call was intentionally produced by a bot looking for vulnerabilities.

YITH Gift Cards for WooCommerce premium
When you purchase gift cards from the online shop (see “WooCommerce – Anna & Juan Online Store”), we record the following data: Sender name, recipient name and email address: We use this data to create and send the gift vouchers. We also record the usual (also see “WooCommerce – Anna & Juan Online Store”) data for other orders.

Our team members have access to the information you provide. For example, administrators and shop managers have access to: Sender name, Recipient name, Recipient email address, Delivery date, Message, Amount and Balance of the gift voucher you purchased.

Flat Rate Boxes
Flat Rate Boxes is used to calculate the shipping costs of orders. We do not use it to transfer data directly to shipping companies. See also item “WooCommerce”.

MailChimp – Newsletter
We use MailChimp from The Rocket Science Group, LLC, 675 Ponce de Leon Ave NE Suite 5000, Atlanta, GA 30308 USA (MailChimp) to send our newsletter. This allows us to contact subscribers directly. In addition, we analyse your usage behaviour in order to optimise our offer.

For this purpose, we pass on the following personal data to MailChimp:

First name (if you provide it)
Last name (if you provide it)

Our e-mails contain a link with which you can update your personal data.

MailChimp is the recipient of your personal data and acts as a processor on our behalf as far as the sending of our newsletter is concerned. The processing of the data provided under this section is not required by law or contract. Without your consent and the transmission of your personal data, we cannot send out a newsletter to you.

In addition, MailChimp collects the following personal data using cookies and other tracking methods: Information about your terminal device (IP address, device information, operating system, browser ID, information about the application with which you list your emails and further information about hardware and internet connection. In addition, usage data is collected such as date and time, when you opened the email / campaign and browser activity (e.g. which emails / websites were opened). MailChimp needs this data to ensure the security and reliability of the systems, compliance with the terms of use and the prevention of abuse. This corresponds to the legitimate interest of MailChimp (according to article 6 para. 1 lit. f GDPR) and serves the execution of the contract (according to article 6 para. 1 lit. b GDPR). MailChimp also collects information about you from other sources. In an unspecified period and scope, personal data is collected via social media and other third-party data providers. We have no control over this process.

The data collected in MailChimp may be transferred to Meta Platforms, Inc. for the purpose of targeted, personalised advertising and may be matched by Meta Platforms, Inc. with their own data. Details can be found in the section “Meta, Custom Audiences and Meta Marketing Services”.

The legal basis for this processing is your consent pursuant to article 6 Para. 1 lit. a GDPR. You can revoke your consent to the processing of your personal data at any time. MailChimp has implemented compliance measures for international data transfers. These apply to all global activities where MailChimp processes personal data of individuals in the EU.
