General Terms and Conditions – Courses/Workshops
Note on non-participation for other reasons: Especially during the winter season and increasingly since the outbreak of the COVID-19 pandemic, we receive partial or complete cancellations of participation in almost every workshop and course unit for various reasons. We fully understand this situation, but we ask you to note that as a small company we have no resources to offer individual solutions in every case. In particular, it is not possible to connect to live events via Zoom or the like, to give free individual lessons to work up the missed material or to prepare the content afterwards as a video.We take the (financial) responsibility if offers cannot take place due to our health or that of the course directors. We are also aware that it is very unpleasant for participants to be unable to attend courses – especially due to illness, but we cannot additionally bear this risk as well. If possible, for health reasons, we offer to make up for missed content at short notice during future classes, but priority is given to newly registered participants. Please contact us and we will put you on the waiting list.As with travelling or cultural events, in some cases, insurance companies will cover the costs or corresponding policies can be concluded in advance.We ask for your understanding. 1. Scope of application
All legal transactions and bookings finalized through the booking page https://annajuan.ch/en/events/… (hereinafter referred to as the “booking page”) are regulated by the present general terms and conditions (hereinafter referred to as the “GTC” or “GTC – Courses/Workshops”). The booking page is run and offered by the general partnership Anna & Juan KLG, hereinafter referred to as Anna & Juan. Anna & Juan reserves the right to change the GTC at any time. The up-to-date version is accessible via the url https://annajuan.ch/en/gtc-courses/. The GTC version accessible during the customer’s booking submission is applicable and binding.
2. Offer
Events, courses and workshops (hereinafter referred to as “courses” or “offers”) respectively prices published on the booking page act as offers. The offer is valid as long as it is accessible and bookable through the booking page. The workshop and course offers of Anna & Juan are exclusively available for customers who are 14 years old or older and are provided exclusively in Switzerland.
3. Products and prices
Anna & Juan reserves the right to define and redefine prices without restrictions and at any time. The price(s) published on the booking page is resp. are applicable during the booking process. In cases of wrongly published prices Anna & Juan reserves the right to inform the customer prior to the booked date and to define a price correction by mutual consent or to cancel the booking entirely.
The prices include VAT, are quoted in CHF and must be paid in this currency.
4. Conclusion of contract
A confirmed booking automatically leads to a binding contract between Anna & Juan and the booking customer, regulated by the present GTC. The booking is confirmed as soon as the booking form is completed and successfully submitted, the full payment has been credited to Anna & Juan’s bank, PayPal or Stripe account or has been paid in cash and a booking confirmation has been sent to the client.
In the case of offers with instalment payments, the booking is confirmed upon receipt of the first instalment payment, provided that the other conditions specified in section 4 are met. The further instalments and payment periods specified in the offer or the cancellation conditions defined in section 6 are binding.
If the booking request is placed less than seven days before the course starts it is automatically confirmed. In case of cancellation by the customer the full course fees have to be paid.
A booking that was not made via the website (e.g., for private events) is considered confirmed as soon as both parties have agreed on it, e.g., by e-mail or verbally. In this case, the terms of payment are also subject to the agreements made, e.g., the booking may be considered confirmed even before the payment has been received. Anna & Juan reserves the right to exclude the client from the agreed offer if the client does not adhere to the agreed payment terms, whereby the payment claim as such remains valid.
5. Payment
The course fees must be issued within the period defined on the booking page (usually 1 work day [bank transfers] or 10 minutes [PayPal and Stripe transfers]). Not paying or not paying on time automatically leads to the cancellation of the booking.
6. Cancellation/postponement by the customer
Day of cancellation = the day the customer’s written cancellation statement arrives at Anna & Juan.
If the customer cancels her or his participation Anna & Juan will raise a handling fee in percentage of the course price:
20% in case of cancellation 31 days or more prior to the beginning of the course.
50% in case of cancellation 15 days or more prior to the beginning of the course.
100% in case of cancellation 14 – 0 days prior to the beginning of the course.
The fees are always calculated on the basis of the total price and not the payments already made (instalments). They allow us to plan the courses and workshops reliably, also and especially with workshop directors from abroad. Please also see the green box at the top left. ↑
Postponing the course at the request of the customer is generally not possible. Nevertheless, the cancellation deadlines of the original booking date remain applicable if Anna & Juan under exceptional circumstances still agree on a postponement.
7. Replacement
Instead of cancelling her or his participation the customer is allowed to send another person in her or his place if the following conditions are met:
a) The replacing person agrees to take over the entire arrangement under the same conditions. A replacement for only parts of a course is not accepted.
b) The customer submits the following data of her or his replacement to Anna & Juan: title, full name, private address, e-mail address and phone number.
In this case, already made payments minus any credit card/PayPal fees will be refunded or the amount will be converted into a voucher upon customer request.
8.1 Course cancellation
Anna & Juan reserves the right to cancel the course, e.g., due to health reasons or a lack of registrations. In such cases the course fees are fully refunded or – by mutual agreement only – the course will be rescheduled and no refund is paid.
In the event of cancellations due to epidemics, pandemics, wars or force majeure in general, whenever possible replacement offers will be organised as soon as the situation allows. If not possible, event fees already paid will be reimbursed to the customer or converted into vouchers for the same amount in CHF. These can be redeemed at a later date, but cannot be converted back into money.
8.2 Change of Venue
Anna & Juan reserves the right to change the venue at short notice if it is in the same place or at a reasonable distance from the originally announced location.
9. Non-acceptance of participant
Anna & Juan reserve the right not to admit participants to the course, especially if the maximum number of participants defined in the announcement is exceeded, if the minimum age of 14 years is not reached or if there are reasons that make the execution of the regular course programme impossible or slow it down. If these reasons are known in good time (at least 30 days before the start of the course) or if the cause lies with Anna & Juan, any payments already made (minus any transaction fees of the payment processors) will be refunded. By mutual agreement, a refund may be waived and participation may be rescheduled.
If the participant disturbs the preparation and/or execution of the course, she/he will be excluded from the offer and loses any right to a refund of payments already made.
10. Payments & refunds – courses
Payments are only accepted in Swiss Francs (CHF) by bank transfer, credit or debit card or in cash. Third party transaction fees (e.g., charged by the issuing bank or company) are fully passed on to the customer. Refunds will be issued using the same payment method as the original payment took place.
11. Accident insurance
It is up to customers to insure themselves against accidents during Anna & Juan offers. Anna & Juan accepts no liability for accidents that occur during workshops, courses or other offers.
12. Non-Compliance with the GTC
In case of a violation of the GTC Anna & Juan reserves the right to refuse the registrants participation and/or take legal action.
13. Privacy and data protection
Personal data is only collected and stored (by Anna & Juan) if necessary to provide the services and events announced on the booking page. It is not used for any other purposes without the explicit permission of the customer. It is only handed over to third parties if necessary to finalize a booking or to execute an event. Third parties may be the payment handling banks or companies (such as PayPal) or external course directors.

14. Exclusion of liability
As far as legally permissible, Anna & Juan excludes all liability in connection with its offers.
15. Protective measures pandemics and epidemics
Any protection concept for the containment of pandemics and epidemics will be drawn up on the basis of the specifications and measures of the federal government, the canton and the city of Zurich, continuously updated and published here. Any changes are effective immediately and are binding for all participating persons, including those who booked at a time prior to the publication of these changes.
16. Law Applicable and Place of Jurisdiction
Within the contractual relationship between you and Anna & Juan Swiss law is applicable exclusively. Law suits against Anna & Juan can only be filed in Zurich, Kanton of Zurich, Switzerland.
